This dude called the bottom - The author of this article writes...Last summer I wrote that it was time to buy residential real estate if you were in the market and looking for a bargain. I never expect to call a market bottom, and certainly not for long-cycle assets like houses, but I seem to have come pretty close. The latest S&P/Case-Shiller survey results, released last week, suggest housing prices bottomed out around April 2009, when its 20-city composite index was down 32.6% from its peak reached in June/July 2006. Since then it has gained 3% through January 2010. I would agree that was the case with Parker CO real estate as well (at sometime in spring of 09.) Read more:

Program to pay homeowners to sell at a loss - The Obama administration is taking a new approach: paying defaulting homeowners to leave their home. This latest program, which will allow owners to sell for less than they owe and will give them a little cash to speed them on their way, is one of the administration’s most aggressive solutions. Taking effect on April 5, the program could encourage hundreds of thousands of delinquent borrowers who have not been rescued by the loan modification program to shed their houses through a process known as a short sale. Lenders will be compelled to accept that arrangement, forgiving the difference between the market price of the property and what they are owed.

62 Days Left...Will it Have any Meaningful Impact?

November 6, 2009, Congress voted to extend and expand the First-Time Home Buyer Tax Credit program. There’s 62 days left to claim it.

The expiration date of the up-to-$8,000 tax credit has been pushed forward to spring, requiring homebuyers to be under contract for a home no later than April 30, 2010, and to be closed no later than June 30, 2010.

In addition, “move-up” buyers were also added to the program’s eligibility list meaning you don’t have to be a first-time home buyer to be eligible for the tax credit. If you’ve lived in your home for 5 of the last 8 years, you meet the IRS requirements.

Move-up buyers are capped at a total tax credit of $6,500.

The tax credit’s basic eligibility requirements remain the same:

You can’t purchase the home from a parent, spouse, or child
You can’t purchase the home from an entity in which they’re a majority owner
You can’t acquire the home by gift or inheritance
All parties to the purchase must meet eligibility requirements
The new law includes some notable updates, however.

First, the subject property’s sales price may not exceed $800,000. Homes sold for more than $800,000 are ineligible. And, also, household income thresholds have been raised to $125,000 for single-filers and $225,500 for joint-filers.

And lastly, don’t forget that the program is a true tax credit — not a deduction. This means that a tax filer who’s eligible for the full $8,00 credit and whose “normal” tax liability totals $5,000 would receive a $3,000 refund from the U.S. Treasury at tax time.

The complete list of qualifying criteria is posted on the IRS website. Review it with a tax professional to determine your eligibility. Then mark your calendar for April 30, 2010.

Short Sales Guideline issued by Treasury Department

Treasury Department Announces Home Affordable Foreclosure Alternatives Program
On November 30, 2009, the Treasury Department released guidelines and forms for its new Home Affordable Foreclosure Alternatives Program (HAFA). HAFA is part of the Home Affordable Modification Program (HAMP). HAFA provides incentives in connection with a short sale or a deed-in-lieu of foreclosure (DIL) used to avoid foreclosure on a loan eligible for modification under the HAMP program. HAFA applies to loans not owned or guaranteed by Fannie Mae or Freddie Mac, which will issue their own versions of HAFA in coming weeks. HAFA is a complex program, with 43 pages of guidelines and forms, designed to simplify and streamline use of short sales and deeds-in-lieu of foreclosure.

HAFA:

Complements HAMP by providing a viable alternative for borrowers (the current homeowners) who are HAMP eligible but nevertheless unable to keep their home.
Uses borrower financial and hardship information already collected in connection with consideration of a loan modification.

Allows borrowers to receive pre-approved short sales terms before listing the property (including the minimum acceptable net proceeds).

Prohibits the servicers from requiring a reduction in the real estate commission agreed upon in the listing agreement (up to 6 percent).

Requires borrowers to be fully released from future liability for the first mortgage debt (no cash contribution, promissory note, or deficiency judgment is allowed).
Uses standard processes, documents, and timeframes/deadlines.

Provides financial incentives: $1,500 for borrower relocation assistance; $1,000 for servicers to cover administrative and processing costs; and up to $1,000 for investors for allowing a total of up to $3,000 in short sale proceeds to be distributed to subordinate lien holders (on a one-for-three matching basis).
The program does not take effect until April 5, 2010, but servicers may implement it before then if they meet certain requirements.

The program sunsets on December 31, 2012.

Well it is what it is. Such a high number of option ARMs will fail, and the loans are concentrated so heavily in fragile bubble markets that they threaten the fragile housing-market recovery. This will affect real estate in Parker CO and everywhere else too, so you can run but you can't hide. Still glad not to be living in CA, AZ, or FL!

This is going to heat up the market and give us some much needed balance! Congress just extended the first time homebuyers tax credit until next April 30th, 2010, but more importantly, added a $6,500 tax credit to buyers who have lived in their homes for 5 years. Woohoo! It's about time other parts of the market start to rock and roll a little. This still won't help the million dollar homes (heaven help these people) because it's only good for purchases up to 800K. Never-the-less, the odds are greater that this incentive will spill up to the luxury end of the market than in the past (as long as there are buyers wanting to trade up to homes of that level.) I'm predicting a VERY healthy Spring for the Real Estate industry!

Contract Timelines Will Affect You

Buyers and Sellers, Your World is Changing, so listen up!

Some changes have taken place on the lending side that will affect your world and you really need to know them when writing contracts. These changes took place 7/30/09. It will affect how contracts are written and how transaction fees are disclosed.

New guidelines for dates:

Loan Application Deadline: 1 day only
Inspection Deadline: 3-4 days
Resolution Deadline: 4-5 days
Appraisal Deadline: 3 weeks minimum
Closing Deadline: 6 weeks
Ideal closing date: around the 20th of each month, NOT THE LAST DAY

Basically what this is going to do is slow down the entire real estate industry. Once the lender gives a good faith estimate, if the APR changes by 1/8 of a point by the closing, new disclosures have to be signed and the clock rolls back on the lending process, causing delays for your buyer.

A 30 day close is going to be next to impossible to pull off. A 45 day close is highly recommended and might be the only thing you can rely on. You need to give enough time for the appraisal process (2 solid weeks after your Inspection Resolution Deadline,) and you do not want to close at the end of the month, or even close to it if you can help it. If that 1/8 rule gets broken at all and the loan is delayed, you better allow yourself breathing room to close it that month. AND if the closing doesn't happen the last day of the month and has to leak into the next month, the APR will automatically change more than 1/8 of a point, and you are guaranteed a 1-2 week delay and a lot of heartache for all parties at that point.

Who is going to look bad in the deals? The lender. And consequently the buyer. And consequently YOU. But the lenders are getting pushed around by these new government rules and they can’t do anything about them.

Most fees to the buyer are going to have to be disclosed to the lender once you are under contract, because he will have to build that into the APR. Also, Title companies are going to have to get used to putting out estimated HUD's sooner than they ever have; anytime a buyer wants to lock in a rate it will be needed so the lender is aware of all of the fees and can disclose them up front.

So be advised that if you ignore these changes potential pain is coming for your contract!

I do NOT agree with the article. I believe we may be at a bottom, but a bottom that will last until 2015, at least price-wise. All we are going to do is chug along the bottom with no appreciation at all. There will still be deal to be had for savvy buyers with good agents though.

Housing starts and sales expected to rise modestly in July

Housing, which led the economy into recession, may be one of the forces that helps to pull it out of the ditch. After 14 quarters of declining investment in homes averaging one percentage point of GDP per quarter, residential investments could actually add to the nation's gross domestic product in the third quarter, economists say. No one expects a renewed housing boom. But at least sales and construction spending aren't falling any more.

Signs of stabilization abound:

Home builders are gradually becoming more hopeful, even though surveys show most builders are still very discouraged. The builders' housing market index has risen in four of the past five months.

Housing starts have increased in four of the past five months after tumbling to a postwar record low. Building permits for single-family homes have risen at a 109% annual rate over the past three months.

Sales of new single-family homes have risen three months in a row after falling to a record low in March.

Sales of existing homes have risen four of the past five months, supporting by a government subsidy for first-time buyers and by sales of foreclosed homes.

Three of these key housing indicators will be released in the coming week, with the fourth arriving a week later. Economists surveyed by MarketWatch expect all four to continue to rise modestly. "Home sales and construction are still at low levels, but evidence is growing that they are past their lows and beginning to rebound," wrote economists for Moody's Economy.com. "Most influences on housing demand are still negative, but with the recession winding down it has become increasingly difficult to sustain the kind of weakness witnessed over the past couple of years." On the positive side: Prices have fallen, mortgage rates are relatively low, and first-time buyers are being subsidized. However, on the downside, jobs are still being lost, home prices are still falling, incomes are stagnant, and credit is still tight. The home builders' index will likely rise to 19 in August from 17 in July. The data will be released on Monday at 1 p.m. Eastern. The next day, the Commerce Department will report on July data for housing starts and building permits. The MarketWatch consensus calls for starts to rise about 2% to a seasonally adjusted annual rate of 596,000 from 582,000 in June. Builders are still deeply pessimistic as a group, but some are clearly finding it profitable to resume building, especially in areas that didn't overbuild during the boom. There are 281,000 new homes for sale, and it's taking nearly a year to sell a home built on speculation once it's been completed. Builders also have to worry about the inventory of condos and existing homes. "The excess inventory is gradually being absorbed," wrote David Greenlaw and Ted Wieseman, economists for Morgan Stanley. "However, the adjustment process will take some time to play out. So we look for only a modest pick-up in homebuilding activity over the near term."

Economists for Bank of America's Merrill Lynch believe starts have rebounded too quickly in recent months, given the massive inventory of competing homes on the market or waiting on the sidelines. They expect starts to drop to a 542,000 rate. The housing starts data are extremely unreliable on a month-to-month basis, with standard errors of more than 10%. However, the data become more reliable on a four-month average. The single-family building permits data are fairly reliable even on a month-to-month basis (standard of error of less than 2%). Sales of existing homes also seem to have found a bottom, but that may due more to artificial supports for buying than any fundamental strength in the market. In recent months, first-time buyers have accounted for a third or more of sales, helped by the government's subsidy. Distressed sales have also accounted for a large, but shrinking, share of sales. Economists think sales probably rose to a 5 million seasonally adjusted annual rate in July from 4.89 million in June.

RE: Tax Credit Guidance for FHA Loans Announced by HUD

In his speech at the National Association of REALTORS Housing Summit on
May 12, 2009, US Department of Housing and Urban Development (HUD)
Secretary Shaun Donovan announced a program that allows borrowers to use
the first-time homebuyer tax credit for a down payment or closing costs on
a FHA-insured mortgage. The Secretary said We think the policy is a real
win for everyone, ensuring that borrowers can tap into the numerous
organizations that are already part of the FHA network to receive this
additional benefit.

The details of the program were announced today in Mortgagee Letter
2009-15. Government entities and instrumentalities of government may
provide a second mortgage. Currently, 10 state housing finance agencies
offer a product buyers can use that will effectively monetize the tax
credit for down payment purposes. These states are Colorado, Delaware,
Idaho, Kentucky, Missouri, New Jersey, New Mexico, Ohio, Pennsylvania, and
Tennessee Get information on these programs at

encouraged to work with their respective housing finance agency to
implement similar programs. The 3.5 percent down payment may also be a
gift from a family member, employer or nonprofit, charitable organization.

The original guidance permitted lenders and HUD-approved nonprofits and
lenders to offer bridge loans via second lien financing or short term
loans. Guidance released today allows lenders to offer the monetized tax
credit for down payments in excess of 3.5 percent, closing costs and
interest rate buy downs. Mortgage industry leaders have indicated that
this type of product may not be immediately available to consumers.
Lenders will need some time to develop documentation for what will
effectively be personal loans to the home buyer.

Rates Are on the Rise! Did You Take Action For Something Better?

In case you haven’t heard, mortgage rates went up drastically Wednesday. To be specific, 0.50% to RATE in 1 day!

The main reason for Wednesday’s tsunami...OVERSUPPLY. The Treasury has literally been printing money by way of Treasury auctions to pay for the massive spending initiatives. Not to mention that these hundreds of BILLIONS of dollars of new Bond supply have to be absorbed by the market, so the additional supply literally weighs on the entire Bond market and drags prices lower. Also, when you think of supply, consider they myriad of refinances and all those loans have been bundled, packaged and sold on Wall Street. This additional supplyhas now started to hit the secondary market, as those closed loans are now getting turned around and sold. This supply also must be absorbed, and while the Fed has been a buyer, they simply can’t buy enough to balance all the selling. It’s Economics 101, anytime supply vastly exceeds demand, prices will move lower. As prices move lower, yields rise and that rise in yield will attract new buyers as they get a higher return on their investment. This process is how the market finds balance.

The question on everyone’s mind, will rates come back? The answer is that we will probably see some improvement, of which we saw a 0.25% decrease in RATE this morning. However, it will be difficult to see rates fight back to the levels they were at just last week. There are both fundamental and technical reasons why a retracement back to last week’s levels would not be easy. We are advising our clients to carefully float.

NAR Chief Economist Speaks Out On Colorado Real Estate

Dr. Lawrence Yun, Chief Economist for the National Association of Realtors, recently spoke in Denver about the economy and home sales in particular. NAR has been lobbying congress about the importance of stabilizing home prices, which will then stabilize the assets of banks, insurance companies, investment firms, and individual homeowners. He is hopeful that the $8,000 credit to first time buyers will act as a strong stimulant to get these first time buyers "off the fence".

Dr. Yun showed statistics that demonstrate how much healthier Colorado's real estate markets are, especially when compared to the four problem states: California, Nevada, Arizona, and Florida. There is good evidence that Colorado has already bottomed out and should have a solid summer sales season. California, which has suffered a severe downturn, is now showing renewed activity. Lower priced California homes are selling well, with multiple bids becoming common. It may be at the "tipping point" where everyone jumps back into the market.

When asked about inflation, Dr. Yun said that inflation is inevitable, given the money being pumped into the economy, so interest rates will be driven up from their current, phenomenally low rates under 5.0%. Those that wait for home prices to drop or interest rates to drop further will probably miss the combination of low prices and low interest rates.

Colorado is a key growth market for real estate over the next 20 years. It continues to enjoy a strong net immigration rate, which should translate into increased demand for mountain resort real estate. He also talked about the influence of the baby boomers, many of whom are buying retirement homes. Mountain Realtors® have also seen the effect of the wealth transfer from the depression generation to the baby boomers, resulting in boomers buying mountain homes. While resort real estate sales have been slow the past couple months, there is pent up demand. The only real question is "when will the buyers get off the fence"?

New York Attorney General, GSEs Release Revised Appraisal Agreement

McLean, V.A. – December 24, 2008 – The National Association of Mortgage Brokers (NAMB) today announced its disappointment with New York Attorney General Andrew Cuomo, Government Sponsored Enterprises Fannie Mae and Freddie Mac (GSEs) and the Federal Housing Finance Agency (FHFA) for issuing its revised Agreement on the Home Valuation Code of Conduct (HVCC) for appraisals. This agreement, in response to an initial investigation into business practices conducted between Washington Mutual and appraisal management company E-AppraiserIT, once again fails to address the appraiser fraud problem. NAMB today issued the following statement from NAMB President Marc Savitt:

“This agreement amounts to a de facto regulatory action which avoids the appropriate process. The law provides for a process to implement regulatory and policy changes such as those contemplated and specified in this agreement.

This agreement will increase costs to consumers and remove thousands of small business competitors from the marketplace. This will create a severe disadvantage to small business mortgage brokers, and prevent them from engaging competitively in the mortgage marketplace.

The HVCC severely threatens small businesses and our respective professions by preventing real estate, mortgage broker, and appraiser professionals from participating in the independent appraisal process. It is critical for mortgage brokers and real estate agents to maintain an appropriate level of contact with appraisers to ensure appraisal quality and appraiser independence.

QUESTION:

I read that the tax credit is "refundable." What does that mean?

The fact that the credit is refundable means that the home buyer credit can be claimed even if the taxpayer has little or no federal income tax liability to offset. This is not a deduction or a reduction in income to reduce tax liability, it is a REFUND. Typically this involves the government sending the taxpayer a check for a portion or even all of the amount of the refundable tax credit. This means that if someone needs to borrow the down payment funds, it will be able to be repaid back after 2009 taxes are filed and the refund is received.

For example, if a qualified home buyer expected, notwithstanding the tax credit, federal income tax liability of $5,000 and had tax withholding of $4,000 for the year, then without the tax credit the taxpayer would owe the IRS $1,000 on April 15th. Suppose now that the taxpayer qualified for the $8,000 home buyer tax credit. As a result, the taxpayer would receive a check for $7,000 ($8,000 minus the $1,000 owed).
